1.    The Interaction Between Business and Regulatory Constraints

1.1 On going regulatory developments concerning alternative networks

The Algerian Parliament has adopted a new law (law number 2000-03 of August 5th, 2000), related to the reform of Post and Telecommunication sectors. It holds several changes with regard to a general policy of liberalisation that is expected to pave the way for more competition between the public operator and the up coming private operators.

This law is devoted to the liberalisation of both post and telecom sectors (each set apart). The development of the competition will be monitored by the State represented by the National Regulation Office / Agency, a body in charge of giving penal sanctions regarding operators which infringe the law.

Regarding the post sector, the law stipulates that postal activities are to be controlled and managed by a public body devoted to commercial and industrial questions/activities. As far as the telecom sector is concerned, the law sets four types of exploitation mode for public and private operators: licence, authorisation, declaration and approval/agreement.

The Ministry of Justice is endowed with an alternative network system that allows the courts all around the country to communicate between each other within the same Wilaya (province).
